Account terms of use

These terms govern the use of your account in the FlexigoTech customer area (app.flexigotech.com). You accept them when you sign up. The account is free.
This English version is a translation for reference only. The Spanish text is the one that applies.
1. Who provides the service

2. What the account is for
The account keeps at hand what you have bought or downloaded for free with your email: the modules and their updates, the invoices and the licences. We also email you when a new version of your modules comes out, and you can manage your privacy: download a copy of your data, choose whether you want to receive news and delete the account.
Your purchases are governed by the General Terms of Sale you accept when paying, and the use of the modules by their licence (EULA). These terms change neither of those two documents. How we process your data is explained in the Privacy Policy.
3. Who can open an account
- Adults with legal capacity to enter into contracts.
- If you open the account for a company, you declare that you can act on its behalf.
- One account per email address. The details you give us must be true and your own.
4. How it is opened
You give your email, choose a password and accept these terms. We send you a link to confirm your email, and the account does not work until you confirm it. If you do not confirm it within 7 days, we delete the sign-up.
5. Keeping your account secure
- Your password must have at least 12 characters, cannot be one of the most common ones, cannot be too similar to your details and cannot be only numbers. Do not use it on other sites.
- We recommend turning on two-step verification with an authenticator app. Keep the recovery codes somewhere safe: without them and without your app, recovering access takes longer.
- Do not share your access. Anything done with your account is taken as done by you, unless you have told us that someone is using it without permission or the fault is ours.
- If you think someone has got into your account, change your password and write to comercial@flexigobe.com.
- We will never ask for your password or your codes, by email or by phone.
- We email you when your password, your email or your two-step verification changes. If it was not you, write to us straight away.
6. What you may not do
- Try to get into other people's accounts, get around the attempt limits or test the security of the service without our written permission.
- Download automatically or in bulk, or load the service more than normal use requires.
- Use the account to hand out modules to people who have no licence. The licence of each module says what you can do with it.
- Impersonate someone else or give false details.
7. Availability
We do what is reasonable to keep the account working at all times, but there may be interruptions for maintenance or faults. If you cannot get in, write to us and we will send you your downloads and invoices by email. An interruption of the customer area does not affect your licences or the modules you have already installed.
8. Changes to these terms
We only change them for one of these reasons: a change in the law or a decision of an authority, the security of the service, functions we add or remove, or changes in how we sell and deliver the modules. Each version has a number and a date, and previous versions remain published.
We will email you at least 15 days before the new version applies, unless the law or a security problem forces us to do it sooner. The next time you sign in we will ask you to accept it to keep using the account. If you do not accept it, you can still read the documents, download your data and delete the account; your purchases and licences do not change.
9. Suspension
We may suspend your account if you breach these terms or the licence of the modules, if there are signs that someone is using it without your permission or if it puts the security of the service or of other people at risk. We will tell you why by email and, except in urgent cases, we will first give you the chance to explain. If you disagree, you can write to us and we will review it. Suspending the account does not cancel your purchases or your licences.
10. Closing and deleting the account
You can delete your account whenever you want from Privacy, in your account, confirming with your password (and your second step, if you have it turned on), or by asking us in writing. When you delete it:
- We delete your email addresses and your password, which closes your sessions, your two-step verification with its codes and your preferences. The account record stays anonymous, without name or email, and deactivated.
- We keep your orders and invoices, with the tax details on them, blocked for 6 years, because the law requires it (article 30 of the Spanish Commercial Code). Free downloads, for the period the Privacy Policy explains.
- We also keep the proof of what you accepted or were informed of, the account's security log and the log of the emails we sent you (type, recipient and status, without the content), each for the period the Privacy Policy explains.
- We send you an email to confirm the deletion.
Your licences are still yours. What you lose is downloading the modules from the account; if you need a copy later, write to us.
If you do not sign in for 12 months, we will warn you by email. If you still do not sign in during the next 30 days, we will delete the account in the same way.
We may also close your account if you seriously breach these terms, or if we stop offering the customer area. In that last case we will give you at least 30 days' notice and send you your invoices and how to keep receiving your modules.
11. Liability
We are liable for the damage we cause you by failing to comply with these terms, within what the law allows. If you use the account as a business or professional, we are not liable for loss of profit or indirect damage, except in cases of wilful misconduct or gross negligence. If you are a consumer, you keep all the rights the law gives you, and nothing in these terms limits them.
12. Complaints
You can complain by email to comercial@flexigobe.com, by phone on +34 616 809 504 or by post to the address in section 1. We will give you a reference number and a receipt for your complaint, and we will answer within 15 days at most (article 21 of the Spanish consumer protection act, TRLGDCU).
We are not a member of any consumer arbitration scheme. If you are a consumer and we do not resolve your complaint, we will tell you in writing about a competent alternative dispute resolution body and whether we will take part in its procedure (article 40.3 of Spanish Law 7/2017). You can also contact the consumer services of your town or region.
13. Law and courts
These terms are governed by Spanish law. If you are a consumer, you can go to the courts of your place of residence and you keep the rights given to you by the law of the European Union country where you live. If you use the account as a business or professional, both parties submit to the courts of Barcelona.
